What Infidelity Means in a California Divorce

California is a no-fault divorce state (Family Code §2310), so a spouse does not need to prove adultery to end a marriage. Evidence of an affair still matters when it touches the issues a court does decide: custody and a child's best interests, spousal support, and community money spent on an affair, which may be subject to reimbursement under Family Code §1101.
